They should make it the responsibility of the senior water rights holder to collect the rain water that falls on someone's house or property if they want it. If they fail to collect it in a period of time that would allow more than 10% of the water to be lost to evaporation or transpiration they forfeit their right to that water. Furthermore, if they fail to collect the water they should be considered to be storing the water on the home/land owners property without their consent and should be fined for not promptly removing their water from the property. Not only that, but the rain is trespassing and the senior water rights holder should be fined for that as well. Sound ridiculous?
